1. VALIDITY OF THE TERMS AND CONDITIONS
The entire Terms and Conditions ("Terms") regarding the services provided ("Services") by the Hong Kong Mass Transit InfoCenter ("HKMTIC", http://www.hkmtr.net) is stated on this page. The Terms apply under any circumstances to the entire HKMTIC. By accessing HKMTIC, you agree, without limitation or qualification, to be bound by the Terms. If you do not wish to be bound by these Terms, you may NOT access or use HKMTIC. The Terms may be modified by HKMTIC at any time, and such modifications shall be effective and valid immediately upon publication of the modified Terms. You agree to review the Terms periodically in order to be acknowledged of the modified Terms.

2. COPYRIGHT OF DATA
Data, such as text and images, published and made available in HKMTIC ("Data") is provided as a part of the Services. The Webmaster owns the copyright of all content of the Data, unless stated otherwise. You may make one (1) machine readable copy or one (1) print copy of any portion of the Data solely for your non-commercial use, which excludes publication of such Data onto the Internet in any way, form or shape. Any other copying, redistribution, modification, selling, publication and/or broadcasting, in any form, of the Data, complete or incomplete, is prohibited without the express written consent of HKMTIC. You agree not to temper with or remove any proprietary notices or indications in the Data.

3. TERMS OF SERVICE
The HKMTIC ("we") aim to provide visitors with information on the subway system (the Mass Transit Railway) in Hong Kong, by means of this web site, the HKMTIC. You understand that we are NOT affiliated with the Mass Transit Railway (MTR) Corporation and its partners. Services provided are not intended for commercial purposes. HKMTIC may be unavailable for viewing due to, without limitation, technical, Internet, or server problems. You understand that we have no control over such unfavorable events, and that the availablility of Services will be resumed immediately once such problems have been eliminated.

Disclaimer. Although care is taken to monitor the quality of information which HKMTIC provides, you understand that it is solely your responsibility to assess the accuracy, authenticity, completeness and usefulness of such information. ALL CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE". WE HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, OR WARRANTIES CONCERNING THE QUALITY OF INFORMATION PROVIDED IN HKMTIC. Guestbook Services. The HKMTIC Guestbook ("Guestbook") is part of the Services. Entries submitted to the HKMTIC by visitors will be published on the Guestbook, which is available to anyone via the Internet. Entries submitted may be modified or rejected by the Webmaster at any time without prior notice and indication, of any form, to visitors. You understand that the email and web site addresses (if any) in any entries were submitted by corresponding visitors, and that we are not responsible for the accuracy and usefulness of these addresses. If you do not wish to be bound by such Terms, you may not submit entries to the Guestbook.

Web Site Listing Services. The HKMTIC Interchange Section exhibits hyperlinks to other related web sites, which is also part of the Services. We do not warrant listing of any and all requests submitted. You understand that we, for any reason, may make modifications to any part of the data submitted in any requests.

Termination of Service. For certain unlikely reasons, the Webmaster may temporarily or permanently terminate the Services provided without explicit prior notice and explanation.

4. HYPERLINKS
There are two types of hyperlinks in HKMTIC: Text Embedded and Image Embedded. They are created for your convenience. By clicking your mouse when the cursor is located on one of these hyperlinks, you will be linked, either in a new window or in the same window of your web browser, to the web page or file which is located in the Internet address embedded in the clicked text or image.

In HKMTIC, hyperlinks that link to web pages or files located outside HKMTIC ("External Objects") are called External Links. All External Links are marked by the symbol "§". By clicking on an External Link, you will proceed to External Objects (such as other web sites and files) in a new web browser window. We have no control over and have not necessarily reviewed any of these External Objects. We also do not make any representations and warrenties about the contents of these External Objects. The Terms published herein do not apply to any and all External Objects under any circumstances. You understand that it is solely your decision to proceed to such External Objects, and that you do so entirely at your own risk.

5. RIGHTS OF THE WEBMASTER
The Webmaster has the right to, at any time, without express prior notice, and for any reason, (i) add, modify and remove any portion of the Data, (ii) modify, reject and remove any Guestbook entries submitted by visitors, (iii) modify, reject and remove any web site listing in the HKMTIC Interchange Section, (iv) make modifications to the Terms and Privacy Policy, and (v) terminate, temporarily or permanently, the Services provided.

7. AMENDMEND OF THE TERMS AND CONDITIONS
The Terms may be modified at any time. The date of when the Terms was last modified is shown at the bottom of this page, followed by the words "Last Amended". You agree to check this date periodically to ensure that you acknowledge and agree to be bound by the latest version of the Terms.

We read every mail thoroughly and will perform appropriate actions as soon as possible. PLEASE ACKNOWLEDGE THAT HKMTIC NEVER SENDS OUTGOING EMAIL ("HKMTIC emails") FROM THE ADDRESS HKMTR@THESKYTRAIN.NET AND PLEASE DISREGARD ANY EMAIL THAT APPEARS TO BE SENT FROM SUCH ADDRESS. You understand that it is your responsibility to assess the authenticity and completeness of HKMTIC emails. In no event, to the maximum extend allowed by applicable laws, shall HKMTIC be liable for any incidential, special, direct, indirect or consequential damages (including, without limitation, damages resulted from injuries, loss of business, revenue, data and information) arising out of, or in connection with the inability to recognize counterfeit HKMTIC emails sent to visitors.
